The Refinery LLC (“The Refinery,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you use The Refinery’s mobile application, Exercise.com-hosted website and account portal, booking services, coaching services, communications, and related features (collectively, the “Services”).

The Refinery’s app and account-management platform are powered by Daxko LLC through its Exercise.com platform. Information submitted through the Services may be processed and stored by Exercise.com on our behalf.

1.  Information We Collect

Depending on how you use the Services, we may collect the following categories of information:

      Account and contact information: Your name, email address, mobile phone number, mailing address, date of birth, profile information, account identifiers, login credentials, profile photograph, and communication preferences.

      Appointments and service information: Appointments, reservations, attendance, cancellations, service history, memberships, packages, purchases, agreements, waivers, intake forms, and related account notes.

      Fitness and wellness information: Fitness goals, workout plans, completed workouts, exercise history, assessments, body measurements, progress information, progress photographs, habit or nutrition information, recovery information, and other fitness or wellness information that you choose to provide.

      Connected-app and wearable information: If you choose to connect a compatible wearable, Apple Health, HealthKit, Google Health Connect, or another health or fitness service, we may receive the information you authorize that service to provide. This information is used only to provide the fitness, coaching, progress-tracking, or wellness features you request and is not used for third-party advertising.

      Communications and user content: Messages with coaches or staff, support requests, form responses, photographs, files, notes, reviews, and other content you submit through the Services.

      Dependent information: If you create or manage a dependent’s profile, we may collect the dependent’s name, date of birth, relationship to you, contact information where applicable, appointments, waivers, service history, and other information needed to provide the requested Services.

      Transaction information: Purchases, subscriptions, packages, payment status, billing information, refunds, and transaction history. Payment-card information is processed by authorized payment processors used through Exercise.com. The Refinery does not directly store complete payment-card numbers.

      Device and technical information: Internet Protocol address, device type, operating system, app version, device or app identifiers, push-notification tokens, login activity, app interactions, diagnostic information, crash information, and similar technical data.

      Notification preferences: Your choices regarding email, SMS/text messages, and mobile push notifications.

2.  How We Use Information

We may use information to:

      Create, maintain, authenticate, and support your account;

      Schedule and manage appointments, services, memberships, packages, and attendance;

      Deliver workout plans, fitness programming, coaching, assessments, progress tracking, recovery services, and related features;

      Process payments, subscriptions, purchases, refunds, and account balances;

      Communicate with you about appointments, reminders, account activity, purchases, coaching, support requests, and service updates;

      Send marketing or promotional communications when you have provided any consent required by law;

      Provide and manage mobile push notifications;

      Personalize and improve the Services;

      Monitor performance, diagnose technical problems, maintain security, and prevent fraud or misuse;

      Enforce our agreements and policies; and

      Comply with applicable legal, tax, accounting, safety, and regulatory obligations.

3.  How We Disclose Information

We may disclose personal information only as reasonably necessary for the purposes described in this Privacy Policy, including to:

      Exercise.com and Daxko LLC: Exercise.com provides the backend platform used for accounts, scheduling, workouts, coaching, messaging, forms, agreements, memberships, payments, notifications, reporting, and other app functions.

      Payment processors: Authorized payment providers may process payment-card information, subscriptions, refunds, and other transactions.

      Communication providers: Email, SMS/text messaging, customer-support, and related providers may process contact and message-delivery information on our behalf.

      Push-notification providers: Apple Push Notification service (“APNs”) and Google Firebase Cloud Messaging (“FCM”) may receive a device token and limited notification information needed to deliver notifications to your device.

      Technology and service providers: Hosting, data storage, security, diagnostics, analytics, and technical-support providers may process information as necessary to operate and protect the Services.

      The Refinery staff and coaches: Authorized personnel may access information needed to manage your account and provide the Services.

      Legal and safety recipients: We may disclose information when reasonably necessary to comply with law, respond to valid legal process, protect rights or safety, investigate fraud, or enforce our agreements.

      Business transactions: Information may be transferred in connection with a merger, financing, acquisition, restructuring, or sale of all or part of the business, subject to applicable law.

      Other recipients with your direction or consent: We may disclose information when you ask us to or authorize the disclosure.

The Refinery does not sell personal information. We do not disclose health or fitness information to third parties for their own advertising purposes.

4.  SMS/Text Messaging Privacy

The Refinery LLC may collect your mobile phone number when you opt in to receive text messages related to appointments, scheduling, reminders, account updates, service notifications, or promotional offers.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the text messaging services.

Message and data rates may apply. Message frequency may vary. You may opt out at any time by replying STOP. You may reply HELP for assistance.

5.  Push Notifications and Communication Choices

If you allow push notifications, the Services may send appointment reminders, account updates, coaching communications, workout information, service notifications, or promotional messages to your device. You may disable push notifications through your device settings.

You may unsubscribe from marketing emails using the unsubscribe link provided in the message. Transactional or service-related communications may continue when necessary to administer your account or provide requested Services.

6.  Data Retention and Account Deletion

We retain personal information while your account is active and for as long as reasonably necessary to provide the Services, complete transactions, maintain business and consent records, resolve disputes, protect the Services, enforce agreements, and satisfy legal, tax, accounting, and regulatory requirements.

Retention periods may vary according to the type of information and the reason it was collected. When information is no longer reasonably necessary, it may be deleted, de-identified, or retained in a limited-access backup or archive until that backup is overwritten according to applicable retention procedures.

You may request deletion of your account and personal information using an account-deletion feature made available through the Services or by contacting us at info@refinery.fitness. Active memberships, subscriptions, outstanding balances, or other contractual obligations may need to be resolved before account deletion can be completed. We may retain information when required by law or when another lawful exception applies.

7.  Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, loss, misuse, alteration, or disclosure. These measures include limiting access to authorized personnel, using reputable service providers, and transmitting information through secured connections where appropriate.

Payment information is processed through authorized payment systems. No electronic transmission or storage method can be guaranteed to be completely secure, and we cannot guarantee absolute security.

8.  Your Privacy Rights and Choices

Depending on your location and applicable law, you may have the right to request access to, correction of, deletion of, or a portable copy of your personal information. You may also have the right to withdraw consent or object to certain uses of your information.

To submit a privacy request, contact info@refinery.fitness. We may need to verify your identity or authority before completing a request. Certain information may be retained when permitted or required by law.

You may update certain account information and communication preferences through the Services. You may also manage app permissions and push notifications through your device settings.

9.  Dependents and Children’s Privacy

The Services are not directed to children under 13. A parent or legal guardian may provide information about a dependent when creating or managing the dependent’s account, scheduling services, or completing required forms. By providing a dependent’s information, you represent that you are authorized to do so.

We do not knowingly collect personal information directly from a child under 13 without appropriate parental or guardian authorization. If you believe information was collected from a child without proper authorization, contact us so we can review and, where appropriate, delete it.

10.  Third-Party Services and Links

The Services may connect to or contain links to third-party services. Those third parties may have their own privacy policies and practices. This Privacy Policy does not govern information a third party collects directly from you outside the Services.

11.  Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in the Services, our data practices, or applicable requirements. The updated policy will be posted with a revised effective date. Your continued use of the Services after an update becomes effective is subject to the updated policy.
